The legal process brought by the McCanns against Goncalo Amaral, in
which Madeleine’s parents request a payment for 1.2
million Euros for the alleged defamation by the ex PJ
inspector has been suspended in an attempt to bring out
of court proceedings.
A legal source told the Lusa agency that the initiations of the
trial, planned for the 24 and 25 of January at the
Lisbon court, “ was suspended because the parties are
trying to find an agreement.
The dispatching of the deciding judge was finalised last week,
giving a period of six months, after which, if there is
no agreement between Goncalo Amaral and the parents of
the child who disappeared in 2007 from the Algarve, a
hearing will be held.
The initiation of this case was delayed twice, the first occasion
being the 9th Feb of 2012.
The judge subsequently noted the commencement of the case at the
Palace of Judgement for the 13th of September of the
same year, with three planned sessions, although none of
them took place given the fact that Goncalo Amaral’s
lawyer was indisposed, undergoing a stomach examination
under anesthesia.
This action, which motivated the confiscation of Goncalo Amaral’s
goods Kate and Gerry McCann claim protection for rights,
freedom and lberty.
In a connected case , 7.ª Vara do Tribunal Cível de Lisboa (Lisbon
Civil Court) in January 2010 maintained the prohibition
of the sale of the book “Maddie: The Truth of the Lie”,
written by Goncalo Amaral and of the video with the same
title, based upon a TV1 video.
The banning of the book and of the video presenting Amaral’s theory
and the involvement of Kate and Gerry McCann in the
disappearance of their daughter together with the hiding
of her body would have been reported on the 9th
September 2009.
On 19th October 2010 the Lisbon Court
annulled the decision of 7a Vara Civil by means of which
the McCann couple made recourse to the Supreme Court of
Justice
.
On 18th March 2011 the Supreme
Court confirms its decision. |
